2010 and 2011 has seen many changes in how short sales are handled. The trends we have noticed in the last six months are creating confusion and risk for all parties involved. What's more, there is an increase in the amount of fraud within the structuring of short sales. Realizing that short sales are going to continue for some time into the future and that our industry will continue to handle these transactions on a regular basis, all real estate professionals need to have a better understanding of the risks involved when assisting in a transaction that involves a short sale.

Currently there has been an increase in litigation regarding short sales. Most of this litigation stems from the seller's misunderstanding that some Lenders authorizing the short sale require the deficiency to be repaid after the sale. Many consumers are under the impression that any short sale acceptance releases them from any further liability under the Note. With this in mind, "protecting the parties involved” in a short sale will focus on basic principles of law, examples of litigation trends, recent legislation and practical advice on how to properly advise a short sale buyer, seller, and Realtor involved in such transactions.

Continuing Education

OLTA has applied for 3.0 CIE(Continuing Insurance Education) Ethics and General Title Credit Hours from the Ohio Department of Insurance. Additionally, OLTA has applied for 3.0 of CLE(Continuing Legal Education) Credit from the Supreme Court of Ohio.

To receive continuing insurance education (CIE) credit, you must do the following for each sessions (an exam is not required to receive credit)

    1. Sign the attendance roster before the session.
    2. Attend the session in its entirety
    3. Complete & sign the request for CIE credits
    4. Turn in the request for CIE credits at the end of the session

Partial CIE credit can be given to attendees of this seminar. The credit must be rounded down to half hour increments

OLTA will only accept National Producer Numbers (NPN) for Continuing Insurance Education credit. We cannot accept social security numbers or license numbers. To find your NPN, visit and select Ohio from the state drop down menu. You may also find your NPN number through under Quick Links/Agent/Agency Locator on the left side of the page.

Requirements for Continuing Legal Education credit have not changed. You are still required to provide your Attorney Registration Number to receive credit.
